Like all states Florida has a process for people to obtain injunctions for protection from violence. They are often referred to as restraining orders, but in Florida the legal term is Injunction for Protection.

Anyone who can demonstrate to the court that they have been or will be a victim of violence and are in fear for their life can obtain an injunction.

Injunctions are a two-step process. Initially a person must first file a petition for injunction with the courts. A court will determine immediately based on the allegations in the petition if a temporary injunction is necessary. Subsequently the case will be set for a hearing and there will be a mini trial to determine whether a permanent injunction should be granted.

Whether you are the one seeking an injunction or the one served with one, you will need an experienced local attorney to assist you with the process. It is very important that all the paperwork be filed correctly, and that you have representation at the hearing to advocate for your side. If you are the victim of violence you will want the best opportunity to obtain the injunction to protect you going forward. If you are served with an injunction and you have done nothing wrong, you will want to make sure you do everything you can to prevent the injunction and the negative consequences that come with it.
