When parents get divorced the courts will determine what happens with any minor children through the divorce process.

A similar process exist for people who have a child but are not married. The courts have the ability to establish paternity and set forth a parenting plan just like they would for divorcing parents.

One of the parents will need to file a petition to establish paternity and establish a parenting plan. The courts will first establish who the parents are, either through agreement of the parties or with DNA testing. Once that is established the courts will then order a parenting plan dealing with time sharing, child support, holidays, vacations, medical issues and schooling.

Like all family law cases, the parties will be required to mediate the case in hopes of resolving it without court intervention. It is important to have an experienced local attorney to help you though the full legal process. Even though you may have never been married, a paternity action can be just as lengthy and complicated. We offer free consultations for you to come in and discuss your case and determine the best way to proceed.
